TERMS & CONDITIONS – ROOM CITY
Welcome to Room City (www.roomcity.in). By accessing, browsing, registering, listing, or using any services provided on this platform, you agree to comply with and be legally bound by the following Terms and Conditions ("Terms"). If you do not agree to these Terms, please discontinue using the platform immediately.
1. PLATFORM NATURE, INTERMEDIARY STATUS & SCOPE
Facilitator Only: Room City operates purely as an online real estate discovery and accommodation aggregator platform. Room City does NOT own, operate, lease, manage, construct, or control any property listed on the platform.
Intermediary Status: Room City functions as an "Intermediary" as defined under Section 2(1)(w) of the Information Technology Act, 2000. It provides an automated listing venue connecting Property Owners/Brokers with prospective buyers, tenants, or guests.
Safe Harbour Protection: In accordance with Section 79 of the Information Technology Act, 2000, Room City is exempt from liability for any user-generated content, property details, media, pricing, or communication posted by users on the platform.
2. USER CATEGORIES & LISTING TAGGING
Room City allows listings under two distinct operational categories:
Property Owner: An individual or legal entity listing a property that they legally own or hold valid authority over.
Property Broker / Agent: An individual or agency listing properties on behalf of third-party owners for commercial purposes or commissions.
Mandatory Tagging & Anti-Misrepresentation: Every listing will be prominently tagged as either an "Owner Listing" or a "Broker Listing." Misrepresenting ownership, impersonating an owner, or failing to declare broker status is strictly prohibited and will result in immediate termination of the listing.
3. LISTING ELIGIBILITY & RESPONSIBILITY
Lister Obligations: The party uploading the listing is solely responsible for ensuring that:
Property details, dimensions, amenities, location, and pricing are accurate.
Uploaded photos and videos are genuine, current, and legally owned by the lister.
The property complies with all local municipal, state, and national housing laws.
Verification Rights: Room City reserves the right (but assumes no legal obligation) to run automated or manual verification checks on listings, profiles, and contact credentials.
4. PRICING, SUBSCRIPTIONS & PLATFORM CHARGES
Owner Listing Fee & Plans: Property Owners may be charged a listing fee on a fixed, city-wise, or property category basis. Room City may also offer monthly or annual owner subscription plans featuring discounted multi-listing rates and enhanced visibility.
Broker Platform Charges: Property Brokers/Agents are required to pay platform usage fees, which may be structured as per-listing, monthly, or quarterly subscription packages.
Fee Modifications: Room City reserves the right to modify its fee structure, promotional plans, or subscription rates at any time with prior notice on the platform.
5. TEAM ASSISTED SERVICES
Optional Services: Room City may offer paid, value-added assisted services, including manual listing creation, professional photography editing, profile optimization, and dedicated account management.
Non-Refundable Policy: Once Room City personnel execute or initiate an assisted service request, all associated service charges become completely non-refundable.
6. PAYMENTS, CANCELLATION & NO-REFUND POLICY
GST & Invoicing: All platform charges, subscriptions, and service fees are exclusive of applicable Goods and Services Tax (GST) unless stated otherwise. GST will be levied per prevailing Indian tax regulations.
Strict Non-Refundable Policy: All payments made to Room City for listing fees, broker subscriptions, property boosting, or assisted services are non-refundable under any circumstances, including:
Unilateral deletion or closure of a listing by the user.
Suspension or removal of a listing due to policy violations, fake listings, or fraudulent reports.
Failure of a listing to generate inquiries or close deals.
7. PROHIBITED CONTENT & CONDUCT
Users must not post, upload, publish, or transmit any material that:
Is fraudulent, fake, misleading, or uses stolen images/intellectual property.
Belongs to another person without authorization.
Is harmful, defamatory, obscene, invasive of another's privacy, or unlawful.
Contains malicious code, viruses, or scraping software designed to disrupt or capture platform data.
Solicits or sends unsolicited commercial communications (spam) to other users.
8. USER CONTENT LICENSE & INTELLECTUAL PROPERTY
Platform IP: All logos, design elements, UI/UX, software code, domain names, and proprietary tools related to Room City are the sole intellectual property of Room City.
License to User Content: By uploading property details, text, images, or videos, you retain ownership of your original content but grant Room City a worldwide, perpetual, non-exclusive, royalty-free, transferable license to host, store, display, reproduce, modify, format, and distribute the content for platform operations, marketing, and promotional activities.
9. NOTICE & TAKEDOWN MECHANISM / GRIEVANCE REDRESSAL
In compliance with the Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021, Room City maintains a dedicated Grievance Mechanism.
Reporting Violations: If any individual, owner, or authority believes that a listing violates their copyright, contains fake information, infringes legal rights, or violates platform policies, they may submit a formal complaint to the Grievance Officer.

Action Timeline: Upon receipt of a valid notice containing property details and supporting evidence, Room City will investigate and take appropriate action (restricting, disabling, or deleting the content) within 36 to 48 hours.
10. DISCLAIMER OF WARRANTIES & LIMITATION OF LIABILITY
No Guarantee: Room City does not guarantee the quality, safety, legality, structural integrity, or availability of any listed accommodation. Room City does not verify tenant credentials or property title deeds.
User Due Diligence: Prospective tenants, buyers, and guests are strictly advised to inspect properties personally and verify physical title deeds, rent agreements, and owner identities before making any financial transactions.
Limitation of Liability: Room City, its proprietor, employees, or agents shall not be held liable for any direct, indirect, incidental, punitive, or consequential damages resulting from rental disputes, monetary fraud between users, property damage, personal injuries, or platform service interruptions.
11. ACCOUNT SECURITY & COMMUNICATION CONSENT
Account Protection: Users are solely responsible for maintaining the confidentiality of their login credentials, OTPs, and passwords.
Communication Consent: By registering on Room City, you consent to receive administrative, security, transaction-related, and promotional communications from Room City via Email, SMS, WhatsApp, and App Notifications.
12. GOVERNING LAW & JURISDICTION
Applicable Laws: These Terms and Conditions shall be governed by, interpreted, and construed in accordance with the laws of India.
Exclusive Jurisdiction: Any legal suit, dispute, or court proceeding arising out of or relating to Room City, its platform, or these Terms shall be subject to the exclusive jurisdiction of the competent courts located in Patna, Bihar, India.
